Introduction

Welcome to Presley Car Rental. By renting a vehicle from us, you agree to be bound by these Terms and Conditions. Please read them carefully before completing your booking.

1. Rental Agreement

1.1 Vehicle Use

  • The vehicle must be used in a careful and lawful manner at all times.
  • The vehicle shall not be used for racing, towing, or any illegal purposes.
  • The vehicle shall not be driven by anyone other than the named renter without prior written consent.
  • The vehicle shall not be taken outside the agreed geographical area without authorization.

1.2 Rental Period

  • The rental period begins at the pickup time and ends at the return time specified in your booking.
  • Late returns will incur additional daily charges at the standard rate.
  • Extensions are subject to vehicle availability and must be approved in advance.

1.3 Driver Requirements

  • The driver must be at least 21 years old (25 for luxury vehicles).
  • A valid driver's license must be presented at pickup and must have been held for at least 1 year.
  • Additional drivers must be registered and approved before driving the vehicle.
2. Security Deposit Policy
Important information about your refundable security deposit

2.1 What is the Security Deposit?

A refundable security deposit is required for all rentals to cover potential damages, excessive cleaning, or policy violations. The deposit amount varies by vehicle and is clearly displayed on the vehicle details page and during checkout.

2.2 When is the Deposit Charged?

The security deposit is charged upfront along with your rental payment. The total amount you pay includes:

  • Rental cost (daily rate × number of days)
  • Security deposit (refundable)
  • Service fees
  • Applicable taxes

2.3 When Will I Get My Deposit Back?

Deposits are refunded within 3-5 business days after vehicle return, provided the following conditions are met:

  • Vehicle is returned on time
  • No damage beyond normal wear and tear
  • Vehicle is returned clean (interior and exterior)
  • Fuel policy is followed (full-to-full)
  • No traffic violations or fines incurred
  • No smoking or pet odors in the vehicle

2.4 What if There's Damage?

If damage is found during our post-rental inspection, we will:

  1. Document the damage with photos and detailed descriptions
  2. Calculate the repair cost based on actual estimates
  3. Deduct the repair cost from your security deposit
  4. Refund the remaining balance (if any) to your original payment method
  5. Send you a detailed breakdown with photos and receipts

You will receive an email notification with complete documentation for any deductions made.

2.5 How is the Refund Processed?

Refunds are processed automatically to your original payment method:

  • PayNow: Refund appears in 1-3 business days
  • Cash: Refund available for pickup or bank transfer

2.6 Common Deduction Reasons

Deductions may be made for (but not limited to):

  • Vehicle Damage: Scratches, dents, broken parts, interior damage
  • Excessive Cleaning: Stains, spills, pet hair, smoking odor
  • Fuel Policy Violation: Not returning with a full tank
  • Late Return: Additional rental days plus late fees
  • Traffic Violations: Parking tickets, speeding fines, toll violations
  • Missing Items: Keys, documents, accessories

2.7 Disputing Deductions

If you believe a deduction was made in error, you may dispute it by:

  1. Contacting us within 7 days of receiving the deduction notice
  2. Providing any evidence that supports your claim (photos, receipts, etc.)
  3. Allowing us 5-7 business days to review your dispute

We will review all disputes fairly and provide a detailed response.

3. Insurance and Liability

3.1 Renter Responsibility

  • The renter is responsible for any damage to the vehicle during the rental period.
  • The renter must report any accidents or damage immediately to Presley Car Rental.
  • The renter is liable for all traffic violations, parking tickets, and fines incurred during the rental.

3.2 Insurance Coverage

Basic insurance coverage is included with all rentals. Additional coverage options may be available at checkout. Please review your coverage details in your rental agreement.

4. Fuel Policy
  • The vehicle will be provided with a full tank of fuel.
  • The renter must return the vehicle with a full tank of fuel.
  • Failure to return with a full tank will result in refueling charges plus a service fee deducted from your security deposit.
5. Cancellation and Modifications
  • Cancellations must be made according to the cancellation policy stated at the time of booking.
  • Rental extensions are subject to vehicle availability and additional charges.
  • All modifications must be approved by Presley Car Rental.
6. Prohibited Activities
  • Smoking in the vehicle is strictly prohibited.
  • Transportation of pets without prior approval is prohibited.
  • Subletting or lending the vehicle to others is prohibited.
  • Using the vehicle for commercial purposes without authorization is prohibited.
